Since 1998, federal law has required the VA to report all veterans appointed a fiduciary to manage their finances to the FBI's National Instance Background Check System (NICS). As a result, these veterans have been unable to purchase firearms from licensed dealers.
The amendment, pushed by Montana Senator Jon Tester, will change the procedure so only individuals deemed unfit to own a firearm by a judge will be submitted to NICS. Tester asserts that many veterans refuse to sign up for VA benefits because they fear that their 2nd Amendment rights will be curtailed.
Because the amendment is attached to the Consolidated Appropriations Act of 2024, it will expire on September 30th, 2024. Tester is working with a bipartisan group to make the change permanent.
